A Beacon of Light and Hope

Yesterday was a red-letter day for human rights in the U.S. Senate.  The senate passed a bill, the Respect for Marriage Act (RFMA), that, if it passes in the House of Representatives, will codify protection for same-sex marriage.  Now, that in itself is an accomplishment worthy of a big WHOO HOO!!!  But even more encouraging, the bill was passed by a margin of 62-37 with 12 Republicans voting in favour!  I had been reading for days about the Republican/conservative backlash against this bill, so when I heard that 12 Republicans voted to protect same-sex marriage, I was stunned … in a good way!

Republican Susan Collins joined forces with Democrat Tammy Baldwin and worked across the aisle to rally support for this bill.  Those Republicans who voted in favour deserve recognition.  In addition to Susan Collins, they are …

  • Rob Portman (Ohio)
  • Thom Tillis (N.C.)
  • Mitt Romney (Utah)
  • Lisa Murkowski (Alaska)
  • Roy Blunt (Mo.)
  • Richard Burr (N.C.)
  • Cynthia Lummis (Wyo.)
  • Shelley Moore Capito (W.Va.)
  • Dan Sullivan (Alaska)
  • Joni Ernst (Iowa)
  • Todd Young (Ind.)

Thank you, Senators!

The RFMA repeals the Defense of Marriage Act (DOMA), a 1996 law that bars the federal government from recognizing same-sex marriages.  It also requires that every state recognize a valid same-sex marriage.  It does fall short of requiring that every state issue licenses for same-sex marriages. The reason for this distinction is to keep the bill from being overridden by the Supreme Court who has previously ruled that the federal government cannot “commandeer” states to enforce federal laws or pass specific statutes. If Congress compelled states to license same-sex marriages, the judiciary would invalidate the law as a violation of this anti-commandeering doctrine.

There has been a very real concern that the Supreme Court is poised to strike down Obergefell v Hodges, the case that requires states to license and recognize same-sex marriages.  Once signed into law, the Respect for Marriage Act will make it more difficult for the Court to overturn the 2015 decision.

As an added bonus, the bill would also protect inter-racial marriages if the ultra-conservative, backward-looking Supreme Court were to decide to overturn the 1967 ruling in Loving v Virginia the ruling that laws banning interracial marriage violate the Equal Protection and Due Process Clauses of the Fourteenth Amendment to the U.S. Constitution.

Next, the bill moves to the House where it is expected to pass, possibly by the end of this week.  If they table it until January, it will be doomed to fail, but at present there is no reason to think it won’t pass the House and be signed into law by President Biden at least by the end of the year.  Score one for human rights, for civil rights, for LGBTQ rights!  Score one for bipartisanship.

Today Is A Dark Day

So, there were no surprises in the Supreme Court ruling in the case of Dobbs v Jackson Women’s Health, but nonetheless it was a gut punch for at least half the people in this nation.  We knew this was to be the outcome, for we read Justice Alito’s leaked opinion on May 2nd and our jaws dropped then, just as they did this morning.

What hypocrisy that yesterday the Court ruled it illegal for states to do ANYTHING to restrict the rights of gun owners, and today the same Court ruled that it is perfectly legal to do EVERYTHING possible to restrict the rights of women.  It should be noted that the majority of gun owners are, in fact, males.  Well, my friends, we women know where we stand.

But it isn’t going to stop here, and Justice Clarence Thomas, husband of insurrectionist Virginia Thomas, has already made that perfectly clear …

“We should reconsider all of this Court’s substantive due process precedents, including Griswold, Lawrence, and Obergefell. We have a duty to correct the error established in those precedents. After overruling these demonstrably erroneous decisions, the question would remain whether other constitutional provisions guarantee the myriad rights that our substantive due process cases have generated.”

The cases he refers directly to are:

  • Griswold v Connecticut – a landmark decision of the U.S. Supreme Court in which the Court ruled that the Constitution of the United States protects the liberty of married couples to buy and use contraceptives without government restriction.
  • Lawrence v. Texas – a decision of the U.S. Supreme Court in which the Court ruled that sanctions of criminal punishment for those who commit sodomy are unconstitutional.
  • Obergefell v Hodges – a landmark civil rights case in which the Supreme ruled that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution.

I have lost all respect for the United States Supreme Court, for they have taken this nation into darkness, have shirked their duty to the U.S. Constitution, to the nation, and to We the People.  Today, the Court is but another arm of the right-wing of the Republican Party, doing not what is in the best interest of the people, but what is demanded by the religious fanatics who would control every aspect of our lives.

The majority of people in this country want gun laws that will protect us and our families from such incidents as Uvalde and Buffalo.  The majority of people in this nation believe women should have the right to make their own health decisions.  But the will of the majority matters not on this dark day, for the spate of recent decisions have all gone against what the majority of people in this nation want.  This can only lead me to believe that in some sense, we are already living under an autocratic government if the will of the majority can be completely disregarded while the will of the few wins the day.  Today, it was women’s rights, but tomorrow …

First they came for the Communists
And I did not speak out
Because I was not a Communist

Then they came for the Socialists
And I did not speak out
Because I was not a Socialist

Then they came for the trade unionists
And I did not speak out
Because I was not a trade unionist

Then they came for the Jews
And I did not speak out
Because I was not a Jew

Then they came for me
And there was no one left
To speak out for me

What About the “Woke” Right?

Our friend Jeff over at On the Fence Voters has neatly summed up the “State of the Nation” these days. Let me just say that by the Republican’s faux definition of the word “woke”, I am PROUD to be WOKE … I have to live with my conscience 24/7 and my conscience likes me being Woke! Thanks Jeff … great summation!

On The Fence Voters

According to our conservative friends, being “woke” refers to those who are ridiculously politically correct and who speak out too much on social injustice. It’s commonly used as a pejorative term when referring to those on the left, increasingly paring it with phrases like “woke mob” or as a sledgehammer, using “anti-woke” to proclaim their vehement opposition.

The right-wing’s been successful at putting the term into the general public. And they do it by minimizing and mocking those standing up against generations of injustice suffered by marginalized folks such as the LGBTQ and people of color communities.

But the truth is, while they like to hang the term on liberals, we could and should hang it around the necks of today’s GOP and use it the same way on them. Because what we’re seeing right now play out across America is beyond radical. Perhaps we could call it “extreme wokeness.”…

The End Of “Liberty and Justice for All”

Yesterday, the United States Supreme Court voted to take away a substantial portion of the rights of women when they voted in private to strike down the 1973 landmark Roe v. Wade decision.  We all saw it coming, but I think we all had our fingers tightly crossed that the Court wouldn’t opt to go down this perilous path.  That hope is gone.  What’s next?  Will we lose our right to “equal pay for equal work”?  Will our voting rights be further restricted (working women are already among the groups for whom voting has been made significantly more difficult)?  Will the Court ultimately also strike down Obergefell v Hodges and take away the rights of same-sex couples to marry?  Just how far is this ignominious Supreme Court willing to push We the People?  And perhaps the bigger question is … how far will we allow them to push us before we push back?  It’s only a matter of time, my friends … only a matter of time.

One line of Justice Samuel Alito’s draft of the decision reads …

“Roe was egregiously wrong from the start …”

Ah yes … anything that allows a woman to have a degree of control over the path her life takes must be considered ‘egregious’, for we all know that Alito and his ilk still believe women to be the inferior gender, unable or incapable of rational thought, of logical decision-making even when it comes to her own body.

My suggestion to all the women in this nation is unless you actively want to get pregnant, make your guys have a vasectomy, else lock the bedroom door and tell him to sleep on the sofa.  Yes, I am serious!  Sex might be fun for both parties, but then we women are left to pay the price for the rest of our lives!

And don’t let those pseudo-Christian evangelicals who fought so hard to make this happen fool you with their “right to life” spiel!  It’s a damn lie.  They claim they are concerned because the fetus might have a chance to become a living, breathing human being.  But you know what happens once the woman gives birth to that little human being?  Those “right-to-life” people disappear.  The mother needs financial help because the sire has disappeared, but where are the “right-to-lifers”?  They bitch and moan about people on welfare and how a few of their measly tax dollars are helping to support single mothers AND those children they were so concerned about back when they were a fetus!  Where is their concern for those little living, breathing human beings now?

And when that little child grows up, graduates from high school with good grades, and wishes to go to college … where are the “right-to-life” folk?  They are busy complaining that some of their tax dollars might go to help pay for his/her education!

Meanwhile, back on the ranch, the sire has moved on, has a continuing prescription for Viagra so that he can go impregnate still more women without accepting either responsibility or consequence.  And the mother?  Well, she has been working two, sometimes three minimum-wage jobs to try to provide the best possible life for that child and has had zero opportunity to improve her own lot in life.

Or maybe, since mom was so busy trying to keep a roof over their heads and food on the table, the youngster didn’t have enough parental supervision, fell in with the wrong crowd, got into drugs and either died of an overdose or else ended up in prison.  Right to life, did you say?  Define life?  Is it simply breathing and having a heartbeat, or is there something about ‘quality of life’?

Or consider the very likely alternative in some cases … back alley abortions will resume and I’d buy stock in wire coat hangers today, for no doubt there will be a run on them soon.  Women will die or be permanently damaged … what was that about “right to life”?

This decision by the Court is the last bit of evidence we needed that the Court has been taken over by partisans … right-wing partisans to be specific.  The three Justices who were appointed under the previous administration were cleverly chosen for both their bigotry and their relative youth, meaning each of the three could conceivably serve for several decades.  Although I have not been in favour of it in the past, I think the time has come to expand the Supreme Court, to level the playing field, to ensure a return to JUSTICE instead of a pandering to the religious fanatics and bigots in the nation.

As it stands now, “Liberty and Justice” for all is a farce … liberty and justice are only for white, straight males.  R.I.P. America … it was nice knowing you, however briefly.

Filosofa’s Frustrations …

Several things crossed my radar this morning that I find relevant … I’m defining relevant as rant-inducing here.

A brief update about the pandemic

Two days ago, Thursday November 12th, the U.S. set yet another record, with 161,541 new cases and 1,190 deaths in a 24-hour period.  Yesterday, Friday November 13th, we broke even that record with 183,527 new cases and 1,395 deaths.  To all those fools who still believe Trump when he says it’s going away … I’ve got a lovely bridge in Brooklyn I’ll sell you really cheap.

Hazards of the job?

When a person applies to become a Secret Service agent, they obviously accept that they will sometimes be in danger, might even be in the literal line of fire, as Special Agent Tim McCarthy was when he stepped in front of President Ronald Reagan during the assassination attempt of March 30, 1981, and took a bullet to the chest.  What they do not expect, however, is that they will recklessly be exposed to a potentially lethal disease.

It was reported yesterday morning that more than 130 Secret Service officers who help protect the White House and the president when he travels have recently been ordered to isolate or quarantine because they tested positive for the coronavirus or had close contact with infected co-workers.  This amounts to roughly 10% of the agency’s core security team, and the infections are believed to have stemmed from the series of campaign rallies that Trump held in the weeks prior to the election.

Now consider that not only are the agents themselves affected, but most have families – spouses and children – who are now also at risk. Donald Trump owes every single one of these agents and their families an apology, yet he has not so much as mentioned the pandemic for days now.  I guess he still thinks it just … went away.  Way to go, Donnie – kill the very people who risk their lives every day to protect your sorry life.

And justice for all???

Justice Samuel Alito has been on the bench of the U.S. Supreme Court since January 31, 2006 when he replaced Justice Sandra Day O’Connor.  Alito is a textualist, meaning he takes the words of the Constitution literally, not allowing for the events that have changed the times over the past two centuries.  He is also a conservative thinker, but until yesterday, I did not realize the extent to which he refuses to consider any opinion that does not fall in line with his own.

Alito delivered an unusually inflammatory public speech Thursday night to the Federalist Society where he said that liberals pose a growing threat to religious liberty and free speech.  Say WHAT???  What has this man been smoking?

His premise was, in a nutshell, that liberal support for LGBT rights such as the right to marry as confirmed by the Supreme Court decision in Obergefell v Hodges in 2015, was a direct assault on religious freedom, for some religions insist that marriage be defined as being between a man and a woman.  Okay, welcome back to the 19th century, Mr. Alito.

The never-ending election

Yesterday evening, the results for the last two states were announced:  North Carolina for Trump, and Georgia for President-elect Joe Biden.  This brings the total electoral votes for Biden to 306 over Trump’s 232 … a comfortable margin.  Biden also leads in the popular vote … by more than 5.2 million.  And yet … Trump and his cronies such as Mike Pompeo and Kayleigh McEnany continue to claim that it will be Trump who is inaugurated on January 20th.

I said a few days ago that we should, and I would to whatever extent possible, ignore his rhetoric … pay no attention to what he says, but focus on actions.  Trouble is that his continual tweets and threats are doing significant damage to the people of this nation … perhaps irreparable harm.  A PEW Research survey shows that 70% of republicans believe the election was not fair.  All of us are on pins and needles, and the U.S. is a tinderbox waiting for just the right spark to set it off.  I am surprised that there has been no major violence in the streets, but how long can that last, with the tension and vitriol that abound?

A top committee made up of officials from the Cybersecurity and Infrastructure Security Agency (CISA) and its election partners refuted Trump’s claims of widespread voter fraud and irregularities in a statement Thursday, calling the election “the most secure in American history.”  And still he throws his tantrum, saying the election was ‘stolen’ from him.  Grrrrrrrrrrrrrrrrrrrrrrrrrr.

Every other president since George Washington has had more respect for We the People than Donald Trump has.  My proposal, if I had the ear of people like Mike Pence, is that he needs to be removed NOW, not in 67 days.  It could be done using the 25th Amendment, and frankly if Pence or Trump’s ignoble cabinet members had a conscience, it would have already been done.  Instead, they will drag the uncertainty and planned chaos out all the way up until noon on January 20th, by which time I and many like me will already be dead from either stress-related illness or from jumping off a tall building.

S-s-snarky S-s-snippets

I am in rather a dark mood tonight … I even yelled at an animated character, a cute li’l octopus, on television and called her a … well, you get the picture.  Two things in particular stirred my angst tonight, and both, I think, are well deserving of venting a bit of snarky steam.

Pathetic

“Suburban women: Will you please like me? Please. Please. I saved your damn neighborhood, okay? The other thing: I don’t have that much time to be that nice. You know, I can do it, but I gotta go quickly. They want me to be politically correct. I got rid of a regulation that was a disaster and it was really unfair, and you’ve been reading about it for a long time and it’s gotten a lot worse under Obama and Biden. We’re going to see that the women really like Trump a lot. Remember four years ago, they said women will never vote, then I got 52 percent. … You damn well better vote for me Pennsylvania, you better vote.”

These are the words of the incumbent in the Oval Office, spoken during a rally in Johnstown, Pennsylvania on Tuesday night.  First he begs and cajoles, then he threatens.  And this is the person who has ‘led’ this nation into chaos for the past nearly four years and hopes to be given another four years to complete the destruction.

Joe Biden, by the way, is leading in the polls in Pennsylvania by an average of 6 points.

Pointless

I have not paid particular attention to, nor written about, the hearings taking place in the Senate to determine whether or not to confirm Trump’s nominee to replace Justice Ruth Bader Ginsburg in the U.S. Supreme Court.  It’s not that I’m not interested – I am.  It’s not that I don’t think it’s important – I do.  It’s just that from what I have read it is just another … yawn … Republican dog-and-pony show with the outcome predetermined.  I truly have better things to do with my time than watch the Republicans preen and Ms. Barrett deflect.

To date, apparently Ms. Amy Coney Barrett has refused to answer all relevant questions, so … what is there to write about?  Ms. Barrett is 48 years old, so We the People are likely to be saddled with her religious views becoming the law of the land for the next three decades or so.

The burning questions that she has refused to answer are on the topics of the Affordable Healthcare Act (whether the majority of us will be able to afford medical care when and if we need it), Roe v Wade (whether women will retain control of their own bodies, or be subject to a misogynistic rule), and Obergefell v Hodges (whether a significant portion of the population will be allowed to marry the person they love, or whether that, too, will be dictated by a bigoted Supreme Court).  Ms. Barrett has refused to answer how she would rule on any of these topics.  In my book, that removes her from consideration, for we have a right to know who will be deciding how we must live.  And would somebody please tell me WHY Ms. Barrett’s children are front and center in the hearings???  They have no role in this, they have no place here!  Best I can figure, it’s another ‘photo op’ moment like Trump having citizens forcibly removed from the streets of Washington so he could hold a bloody book in front of a damn church!  Send the children home to do their online learning, Amy!  Better yet … go home with them, since you have proven yourself useless.BarrettIn the Republican’s book however, it is a little different.

Here are some of the questions Ted Cruz, a republican senator from Texas asked of Ms. Barrett:

  • Do you speak any foreign languages? (French)
  • Do you play any musical instruments? (Piano)
  • What was it like staying at home during the pandemic with seven children? (Challenging)
  • Why did she and her husband adopt two children from Haiti? (A long story)

Ooooohhh … what relevant questions for a potential Supreme Court Justice who will be expected to make decisions that may mean life or death for us all!  Way to go, Teddy!

Now, one thing I didn’t mention above was Ms. Barrett’s take on climate change, arguably the single most important issue of the day.

“I’m certainly not a scientist. I have read things about climate change. I would not say I have firm views on it.”

Say WHAT?  You have “read things”???  What things?  Details, woman!  How … HOW can anybody in this, the year 2020 with wildfires consuming much of the West Coast, with devastating hurricanes costing lives and untold property damages, and with the average temperature this past summer 92° in an area that usually has a summertime average of 85° … how can any sane person look at the statistics, step outside and attempt to breathe the air, and still have “no firm views”???  This woman is either very, very stupid, else she is already in the pockets of the corporate donors such as Koch Brothers and the fossil fuel industry!

I’m not a scientist, either, but I still possess some parts that Ms. Barrett may be missing:  a brain, eyes, ears, and lungs … all of which tell me that humans, in their greedy quest for more useless money, have begun and continue the destruction of the environment here on planet Earth.

So, in conclusion, Ms. Barrett refuses to voice an opinion on women’s rights, LGBT rights, the right to medical care, and worst yet, she is stupid about the environment.  GET. HER. OUT.

But no, the boot-lickers in the Senate have a majority, albeit a narrow one, and there doesn’t seem to be a single one with the cojones to “just say ‘no’” to Donald Trump.  On top of that, the unconscionably powerful Koch Brothers have thrown their support behind her nomination.  And thus began the beginning of the end of civilization in what was once known as the United States.

And I shall end on that note, for my temper is about to take me where I ought not to go.  Let me just say, though, that if Donald Trump is elected for and seated for another term, I shall renounce my citizenship from the U.S., if not from the entire world.  I can see nothing good in the future of this nation if the people continue to elect and applaud bloody fools and to put corporate profits ahead of people.
